PRAMOD KUMARversusANANT PRASAD

Decided

Holding

The High Court directed the Civil Judge (J.D.) Hamipur to decide the original suit No.07 of 2010 expeditiously, without unnecessary adjournments.

Summary

The petitioner, Pramod Kumar, filed a writ petition under Article 227 seeking a direction to the Civil Judge (J.D.) Hamipur to decide the pending original suit No.07 of 2010 against Anant Prasad. The petitioner argued that the suit should be decided expeditiously. The Court noted that the suit was still pending and that keeping the writ petition alive would serve no useful purpose. Consequently, the Court disposed of the writ petition, directing the civil judge to decide the original suit promptly, without unnecessary adjournments, ensuring service of notice and opportunity to be heard.
