VIJENDRA SINGHversusTIKAM SINGH AND ANOTHER

Decided

Holding

The writ petition is disposed of with a direction to the trial court to decide the civil suit expeditiously, without unnecessary adjournments and with proper notice to all parties.

Summary

The petitioner, Vijendra Singh, filed a writ petition under Article 227 seeking a direction to the trial court to expedite the pending Civil Suit No.433 of 2014 against Tikam Singh. The petitioner’s counsel requested that the suit be decided expeditiously, arguing that the writ petition had no further purpose while the suit remained pending. The Court observed that the pending suit needed to be decided without unnecessary adjournments and with proper service of notice to all respondents. Consequently, the Court disposed of the writ petition, directing the trial court to decide the civil suit promptly, ensuring due process and opportunity to present evidence, provided no other legal impediment exists.
