Allahabad High Court

VINDHYAWASINversusSMT. PRATIMA PANDEY

Decided

Holding

The writ petition is disposed of, with a direction to the Family Court to decide the matrimonial case expeditiously in accordance with Section 21-B of the Hindu Marriage Act, 1955.

Summary

The petitioner filed a writ petition under Article 227 seeking a direction to the Additional Principal Judge of Family Court No.2, Allahabad, to decide the pending matrimonial suit (No.1143 of 2024) under Section 13 of the Hindu Marriage Act, 1955 on an expedited basis. The petition specifically requested that the family court adhere to the timeline mandated by Section 21-B of the same Act and avoid unnecessary adjournments. The High Court observed that the matrimonial case was already pending and that keeping the writ petition alive would serve no useful purpose. Consequently, the court disposed of the writ petition while issuing a directive to the family court to decide the matrimonial case expeditiously, subject only to any legal impediment. The order emphasizes strict compliance with Section 21-B to prevent undue delays.

                                    1. Heard.

                                    2. In view of the order, which is being proposed to be passed today, notices
are not being issued to the respondents.

                                    3. The solitary relief claimed in the present writ petition is for a direction to
the Additional Principal Judge, Family Court No.2, Allahabad to consider
and decide the Matrimonial Case No.1143 of 2024 (Vindhyavasani vs. Smt.

                                    4. Learned counsel prayed that the said suit may be decided, expeditiously.

                                    5. Since the above-mentioned case is pending, no useful purpose would be
served in keeping this petition pending.

                                    6. In view of the above, this writ petition stands disposed of with a direction
to the Additional Principal Judge, Family Court No.2, Allahabad to consider
