Allahabad High Court

RAM SAKHIversusARVIND AND 6 OTHERS

Decided

Holding

The High Court directed the Civil Judge (J.D.), Paschimi, Ballia to decide the pending suit expeditiously, without granting unnecessary adjournments, subject to legal impediments.

Summary

The petitioner, Ram Sakhi, filed a writ petition under Article 227 seeking a direction to the Civil Judge (J.D.) of Paschimi, Ballia to decide the pending suit (Case No.1022/2021) against the respondents expeditiously and without unnecessary adjournments. The petitioner’s counsel argued that the suit’s delay was unwarranted and that a court order was necessary to compel a speedy trial. The Court observed that the suit was already pending and that keeping the writ petition alive would serve no useful purpose. Consequently, the Court disposed of the writ petition while directing the lower court to decide the suit promptly, subject to any legal impediment. No notices were issued to the respondents, and the petition was dismissed with the specified direction.

                                    Counsel for Respondent(s)                           :

                                    Court No. - 5
                                                          HON'BLE VIKAS BUDHWAR, J.

                                    1. Heard.

                                    2. In view of the order, which is being proposed to be passed today, notices
are not being issued to the respondents.

                                    3. The solitary relief claimed in the present writ petition is for a direction to
the court of Civil Judge (J.D.), Paschimi, Ballia to decide the Case No.1022
2021 (Ram Sakhi Vs. Arvind others) expeditiously within stipulated period
as fixed by this Hon'ble Court without providing unnecessary adjournment
                                    either of the parties.

                                    4. Learned counsel prayed that the said suit may be decided, expeditiously.

                                    5. Since the above-mentioned case is pending, no useful purpose would be
served in keeping this petition pending.

                                    6. In view of the above, this writ petition stands disposed of with a direction
to the Civil Judge (J.D.), Paschimi, Ballia to decide the Case No.1022 2021 (
Ram Sakhi Vs. Arvind others), expeditiously, without granting any
unnecessary adjournments, subject to legal impediment.
