Allahabad High Court

SEEMENDRA BHATNAGARversusSHYAM SRIVASTAVA

Decided

Holding

The High Court disposed of the writ petition, directing the Civil Judge to decide the original suit expeditiously.

Summary

The petitioner, Seemendra Bhatnagar, filed a writ petition under Article 227 seeking a direction to the Civil Judge (J.D.) Kanpur Nagar to decide Original Suit No. 920/2024 (Shyam Srivastava v. Seemendra Bhatnagar and others) within a specific period. The petition solely requested expeditious disposal of the pending suit. The Court observed that issuing notices to the respondents was unnecessary and that keeping the writ petition pending would serve no useful purpose while the suit itself remained unresolved. Consequently, the High Court disposed of the writ petition and directed the lower court to decide the original suit expeditiously as per its roster. The order was pronounced on May 6, 2026 by Justice Vikas Budhwar.

                                    1. Heard.

are not being issued to the respondents.

                                    3. The solitary relief claimed in the present writ petition is for a direction to
concerned Court to decide the Original Suit No. 920/2024 (Shyam
Srivastava Versus Seemendra Bhatnagar and others), pending before the

                                    4. Learned counsel prayed that the said suit may be decided, expeditiously.

                                    5. Since the above-mentioned case is pending, no useful purpose would be
served in keeping this petition pending.

                                    6. In view of the above, this writ petition stands disposed of with a direction
to the Civil Judge (J.D.) Kanpur Nagar to decide the Original Suit No.
