Allahabad High Court

SMT. REENA YADAVversusMUKESH AND ANOTHER

Decided

Holding

The writ petition is disposed with a direction to the Civil Judge (SD) Budaun to decide the interim injunction application preferably within eight months, without unnecessary adjournments.

Summary

The petitioner, Smt. Reena Yadav, filed a writ petition under Article 227 seeking a direction to the Civil Judge (SD) Budaun to decide an interim injunction application pending in Original Suit No. 102/26 within a specified period and to maintain status quo over the disputed property until final disposal. The petitioner argued that the suit needed expeditious resolution. The court observed that since the original suit was still pending, continuing the writ petition would serve no useful purpose. Consequently, the court disposed of the writ petition, directing the civil judge to decide the interim injunction application preferably within eight months, without unnecessary adjournments, subject to legal impediments. The order also noted that no notices would be issued to the respondents.

Issues considered

  • Whether the High Court should direct the Civil Judge (SD) Budaun to decide the interim injunction application in the original suit expeditiously
  • Whether the writ petition should be continued or disposed of given the pendency of the original suit

are not being issued to the respondents.

                                    3. The solitary relief claimed in the present writ petition is for a direction to
the Civil Judge (SD) Budaun to decide interim injunction application filed
by petitioner in Original suit No. 102/26 (Smt. Smt. Reena Yadav Vs Sri
Mukesh and another) pending before Civil Judge (SD) Budaun, within
specified period as stipulated by this Hon'ble court and further be directed to

disposal of the 6c application filed by petitioner.

                                    4. Learned counsel prayed that the said suit may be decided, expeditiously.

                                    5. Since the above-mentioned case is pending, no useful purpose would be
served in keeping this petition pending.

                                    6. In view of the above, this writ petition stands disposed of with a direction
to the Civil Judge (SD) Budaun to decide interim injunction application filed
