The writ petition is disposed of with a direction to the Civil Judge to decide the temporary injunction application within eight months.
Summary
Petitioner Imran Ali filed a writ petition under Article 227 seeking a direction to the Civil Judge (Junior Division) at Khaga, Fatehpur to decide his application for a temporary injunction in Original Suit No. 240 of 2025. The petitioner argued that the suit required expeditious disposal. The Court observed that since the underlying suit was pending, the writ petition served no useful purpose if kept alive. Consequently, the Court disposed of the writ petition, directing the lower court to decide the injunction application within eight months of receiving the certified copy of the order, without unnecessary adjournments. The direction was issued subject to any legal impediment.
Issues considered
- Whether a writ petition under Article 227 seeking a direction to a lower court to decide a temporary injunction application is maintainable.
