Allahabad High Court

ARADHANAversusPRABHAKAR PATEL

Decided

Holding

The High Court exercised its supervisory jurisdiction under Article 227 to order the subordinate court to decide the pending suit expeditiously and disposed of the writ petition.

Summary

The petitioner Aradhana filed a writ petition under Article 227 seeking a direction to the Additional Civil Judge (Junior Division) Court No.5, Allahabad, to decide her pending civil suit (Case No. 2292 of 2025) within the stipulated time. The petitioner’s counsel requested an expeditious disposal of the suit, arguing that continued pendency served no useful purpose. The High Court noted that the suit was already pending and that the petition’s sole relief was to compel the lower court to act promptly. Consequently, the Court disposed of the writ petition, directing the lower court to decide the suit expeditiously, without granting unnecessary adjournments and without issuing notice to the respondent. The order emphasizes the supervisory jurisdiction of the High Court under Article 227 to ensure timely justice in subordinate courts.
