Allahabad High Court

SHRI KRISHNA JANAMSTHAN SEWA SANSTHANversusPOORAN SINGH RAGHAV AND 5 OTHERS

Decided

Holding

The writ petition is disposed of with a direction to the Additional District Judge, Essential Commodities Act Court No. 10, Mathura, to dispose of the pending restoration applications and civil appeal expeditiously within one year.

Summary

The petitioner, Shri Krishna Janamsthan Sewa Sansthan, filed a writ petition under Article 227 seeking a direction to the Additional District Judge, Essential Commodities Act Court No. 10, Mathura, to expedite the disposal of pending restoration applications (Nos. 122 of 2025 and 324 of 2024) and a civil appeal (No. 137 of 2013). The petition argued that the pending matters required early and expeditious resolution. The High Court noted that keeping the writ petition pending served no useful purpose while the underlying matters were still pending. Consequently, the Court disposed of the writ petition and issued a direction to the lower court to dispose of the pending applications and appeal within one year, without unnecessary adjournments, subject to any legal impediment. No notices were issued to the respondents.

Issues considered
