Allahabad High Court

MUNNI DEVIversusUMA DEVI

Decided

Holding

The High Court exercised its supervisory jurisdiction under Article 227 to direct the Civil Judge to decide the pending civil suit as per the roster and disposed of the writ petition.

Summary

The petitioner, Munni Devi, filed a writ petition under Article 227 seeking a direction to the Civil Judge (Junior Division) Court No.10, Deoria, to decide the pending civil suit (Original Suit No. 1606 of 2023, Uma Devi v. Munni Devi) within a stipulated period. The petitioner’s counsel urged expeditious disposal of the suit. The High Court observed that since the civil suit was already pending, maintaining the writ petition would serve no useful purpose. Consequently, the Court ordered the writ petition to be disposed of and directed the lower court to decide the civil suit as per its roster. No notices were issued to the respondent, and the petition was closed with the said direction.

                                                          HON'BLE VIKAS BUDHWAR, J.

                                    1. Heard.

                                    2. In view of the order, which is being proposed to be passed today, notices
are not being issued to the respondent.

                                    3. The solitary relief claimed in the present writ petition is for a direction to

                                    4. Learned counsel prayed that the said suit may be decided, expeditiously.

                                    5. Since the above-mentioned case is pending, no useful purpose would be
served in keeping this petition pending.

                                    6. In view of the above, this writ petition stands disposed of with a direction
to the Civil Judge (Junior Division) Court no.10 Deoria, District Deoria to
