Allahabad High Court

LEELAWATIversusKANHAIYA AND 2 OTHERS

Decided

Holding

The High Court exercised its supervisory jurisdiction under Article 227, directing the Civil Judge (Junior Division) Jaunpur to decide the original suit expeditiously and disposed of the writ petition.

Summary

Petitioner Leelawati filed a writ petition under Article 227 seeking a direction to the Civil Judge (Junior Division) in Jaunpur to dispose of her original suit No. 257 of 2010 against Kanhaiya and two others. The petition sought an order for early disposal within a period prescribed by the High Court in the interest of justice. The Court noted that the original suit was still pending and that keeping the writ petition alive would serve no useful purpose. Accordingly, the Court disposed of the writ petition and directed the subordinate judge to decide the original suit expeditiously, without unnecessary adjournments, subject to any legal impediment. The order was pronounced on 18 May 2026.
