Allahabad High Court

SMT. NEERAJ @ NAINA AND 3 OTHERSversusSTATE OF UTTER PRADESH AND ANOTHER

Decided

Holding

The petition was dismissed and the High Court directed all pending litigations between the parties to be disposed of in accordance with the compromise recorded by the Mediation Centre.

Summary

The petitioners sought relief under Article 227 of the Constitution to set aside two lower‑court orders dated 11 June 2025 and 28 January 2025 involving IPC offences. They claimed that the disputes underlying those orders had been amicably resolved through the Allahabad High Court Mediation and Conciliation Centre, whose report dated 10 December 2025 was placed on record. The High Court examined the mediation report, found that a genuine compromise had been reached, and consequently directed all courts where related matters were pending to dispose of them in accordance with the settlement. No order was set aside; instead the petition was dismissed and the matter was closed. The mediation report was ordered to be kept as part of the record.

Issues considered

  • Whether the High Court can entertain a petition under Article 227 to set aside orders of lower courts in criminal matters.
  • Whether a settlement arrived at in a court‑administered mediation can be enforced on pending litigations before other courts.
  • Whether the High Court may direct other courts to dispose of cases in light of a compromise.
