Allahabad High Court

GYAN SINGHversusSTATE OF U.P. AND ANOTHER

Decided

Holding

The Court dismissed the application under Section 482 CrPC as no counsel appeared to press it, resulting in a dismissal for want of prosecution.

Summary

Gyan Singh filed an application under Section 482 of the Criminal Procedure Code seeking to quash the charge sheet and the criminal proceedings against him in Criminal Case No. 40 of 2023, which involved offences under Sections 406, 504 and 506 of the IPC. The applicant’s counsel, Kamal Singh, did not appear before the court despite the hearing being listed. The State’s counsel and counsel for the second opposite party were present and highlighted procedural deficiencies. Since no representation was made on behalf of the applicant, the court dismissed the application for want of prosecution. Consequently, any interim order previously granted was vacated and any pending applications were ordered disposed.
