The High Court allowed the application under Section 482 CrPC and quashed the Family Court's order.
Summary
The applicant, Harshit Raj Sangam, filed an application under Section 482 of the Criminal Procedure Code seeking to quash an order dated 20 March 2024 passed by the Additional Principal Judge of the Family Court, Basti, in case No. 480/11/23 (Khushbu Prajapati and Another vs. Harshit Raj Sangam) which was issued under Section 125 CrPC. The parties later reached a full and amicable compromise, expressing that they have no grievance against each other. Relying on the compromise, the High Court exercised its inherent powers under Section 482 CrPC and allowed the application, thereby quashing the Family Court's order. The decision underscores the court's authority to set aside criminal proceedings when the parties have settled the dispute. The order was pronounced by Justice Manju Rani Chauhan on 21 September 2026.
