The application for quash under Section 482 CrPC is dismissed, and the criminal proceedings are allowed to continue.
Summary
The applicants filed an application under Section 482 of the CrPC seeking to quash the criminal proceedings (Case No. 22414 of 2024) instituted by the State of U.P. for offences under IPC sections 498A, 323, 504, 506, 354-A, 427 and Sections 3 and 4 of the Dowry Prohibition Act. The High Court examined the material and observed that, at the preliminary stage, it could not be said that no offence was made out against the applicants; the disputes were factual in nature and not suitable for adjudication in a quash petition. The Court reiterated that the power to quash is to be exercised only where there is a clear failure of justice or abuse of process, which was not evident here. Consequently, the prayer to quash the proceedings was declined. The Court directed that if the applicants are not on bail they may apply for bail within 45 days, and that any application for discharge should be decided by the trial court within two weeks, with no coercive measures taken during that period.
Issues considered
- Whether the High Court can quash the criminal proceedings under Section 482 CrPC on the ground that no offence is made out against the applicants.
