Allahabad High Court

DEVESHversusState of U.P. AND ANOTHER

Decided

Holding

The High Court dismissed the application, holding that no interference with the mediation process was warranted.

Summary

The applicant, Devesh, filed an application under Section 482 of the CrPC seeking interference with a mediation process ordered on 13 May 2024. The matter had been referred to the Mediation and Conciliation Centre, which reported on 12 July 2024 that the applicant had not complied with the order to deposit money, preventing issuance of notices to the opposite parties. The applicant argued that there were chances of settlement and obtained an interim order, which he allegedly used to his advantage. The High Court examined whether any interference with the mediation proceedings was warranted. Finding that the applicant's claim of settlement prospects was unsubstantiated and that the mediation process was ongoing, the Court held that no interference was justified. Consequently, the application was dismissed on 12 May 2026.

Issues considered

  • What is the appropriate scope of the High Court's inherent powers under Section 482 in interfering with a mediation proceeding?
  • Whether the applicant is entitled to any relief on the ground of alleged chances of settlement.
