Allahabad High Court

MAHESH AND ANOTHERversusSTATE OF U.P. AND ANOTHER

Decided

Holding

The application under Section 482 is allowed and the criminal proceedings are quashed.

Summary

The applicants filed an application under Section 482 of the Criminal Procedure Code seeking to quash the summoning order dated 6‑Nov‑2022 and the entire criminal proceedings (Complaint No.1203 of 2021, Meenu Singh v. Mahesh et al.) involving offences under IPC sections 498A, 323, 504 and sections 3 and 4 of the Dowry Prohibition Act. The applicants argued that a compromise had already been recorded in a related matter, Smt. Usha and others v. State of U.P. (Article 227 No.1616 of 2024), which arose out of the same set of facts. The State’s Additional Government Advocate concurred that the same compromise covered the present case and raised no objection to terminating the criminal proceedings. The High Court, after considering the compromise, allowed the application and quashed the pending criminal proceedings. The order was dated 11‑Sept‑2026 and signed by Justice Vikram D. Chauhan.

Issues considered

  • Whether the High Court can quash criminal proceedings under Section 482 CrPC when a compromise has been recorded in a related proceeding arising from the same facts.
