The application is dismissed as not pressed.
Summary
The applicant, a minor, filed an application under Section 482 of the Criminal Procedure Code seeking to quash an order dated 12‑April‑2024 passed in Criminal Case No. 92 of 2024. The order concerned a direction under Section 156(3) CrPC issued by the Circle Officer, Harsh Pandey. During the hearing, the applicant’s counsel indicated that they no longer wished to pursue the present application and instead sought liberty to file a suitable application before a competent court later. The court ordered that the certified copy of the impugned order be returned to the applicant’s counsel after retaining a Xerox copy. Consequently, the court dismissed the application on the ground that it was not pressed. The dismissal was without prejudice, allowing the applicant to approach the court later with an appropriate petition.
Issues considered
- Whether an application under Section 482 CrPC seeking to quash an order can be dismissed when the applicant does not press the application.
- Whether the court may grant liberty to the applicant to file a suitable application before a competent jurisdiction at a later stage.
