Allahabad High Court

JITENDRAversusSTATE OF U.P. AND ANOTHER

Decided

Holding

The High Court declined to quash the order, holding that the matter involved factual disputes and did not constitute an abuse of process warranting intervention under Section 482.

Summary

The applicant filed an application under Section 482 of the Criminal Procedure Code seeking to quash a Judicial Magistrate's order dated 16‑04‑2019 in a criminal case (State vs. Praja Ram) involving offences under Sections 498A, 323, 504, 506 IPC and Sections 3/4 of the Dowry Prohibition Act. The High Court examined the record and held that, at the pleading stage, it could not be said that no offence was made out against the applicant; the disputes were factual and not suitable for interference under Section 482. Consequently, the court declined the prayer to quash the order, noting that the power under Section 482 is to be exercised only in cases of abuse of process or failure of justice. The court directed that if the applicant is not on bail, he may apply for bail within 45 days, and any discharge application must be decided by the trial court within six weeks. For a period of 45 days or until the discharge application is disposed, no coercive measures may be taken against the applicant. The application was therefore disposed.

Issues considered

  • Whether the High Court can quash the Judicial Magistrate's order under Section 482 Cr.P.C. on the ground that no offence is made out against the applicant.
