Allahabad High Court

SURAJ CHANU CHOURASIYA @ SURAJ CHOURASIYAversusSTATE OF U.P.AND 3 OTHERS

Decided

Holding

A verified out‑of‑court settlement between the parties justifies quashing of the criminal proceedings under Cr.P.C. Section 482.

Summary

The applicant, Suraj Chourasiya, filed a Cr.P.C. Section 482 application seeking to quash the criminal complaint (case 117 of 2018) filed under IPC sections 363, 366, 376 and POCSO Act sections 3/4, on the ground that the parties had reached an out‑of‑court compromise which was verified by the Special Judge. The compromise deed dated 26‑Nov‑2025 was filed and subsequently verified by the trial court on 2‑Feb‑2026. The opposite party (No. 2) and the State did not contest the existence of the settlement, though the State opposed the quash order. The Court examined precedent that settlements between parties justify quashing of criminal proceedings under Section 482. Relying on Supreme Court decisions such as B.S. Joshi v. State of Haryana and Nikhil Merchant v. CBI, the Court held that the verified compromise warranted dismissal of the pending proceedings. Consequently, the Court quashed the summoning order of 30‑Apr‑2019 and the Special Judge’s order of 4‑Apr‑2023, granting the applicant’s relief.

Issues considered

  • Whether a criminal proceeding can be quashed under Cr.P.C. Section 482 on the basis of an out‑of‑court settlement verified by the trial court.

4. Learned counsel for the applicant argued that the parties have settled
the dispute amicably out of court and on the basis of compromise the
applicant filed the present application before this Court in which an order
for verification of the compromise was passed on 17.12.2025. It is argued
that in compliance of the said order of this Court, the parties have filed
the order of this Court along with certified copy of the supplementary
affidavit and its annexure being the compromise deed dated 26.11.2025
before the concerned court for its verification after which the concerned
court has verified the said compromise vide its order dated 02.2.2026,
copy of the said verification order has been placed on record by the office
through its report dated 3.2.2026. It is argued that the opposite party no. 2
is not interested to pursue the matter pending in the trial court and is not
inclined to give any evidence against the applicants and therefore the
impugned proceedings be quashed on the ground of compromise between
the parties.

5. Learned counsel for the opposite party no. 2 could not dispute the
factum of compromise and submits that he has no objection to it.

6. Learned State counsel although opposed the prayer for quashing but
could not dispute the fact that the matter has been amicably settled
between the parties which was duly verified by the concerned trial court.

7. The law with regards to quashing of a case on the basis of settlement
arrived between the parties, is well settled. The Apex Court in the cases of
