Allahabad High Court

CHANDversusSTATE OF U. P.THROUGH PRINCIPAL SECRETARY HOME GOV. OF U.P.

Decided

Holding

The Court dismissed the application under Section 482 Cr.P.C. as not pressed.

Summary

The applicants Chand, Mausin, Rashid and Mohd. Nazim filed an application under Section 482 of the Criminal Procedure Code seeking to quash an order dated 31.08.2021 passed by the Special Court under the POCSO Act and to stay further proceedings. The application was initially filed for Chand, and later three additional persons were impleaded through a separate application. During the hearing, the Court observed that applicants Mausin and Rashid were not named as accused in the original order and had not been summoned. The applicants argued that the impleadment was improper and sought dismissal of the Section 482 application, indicating an intention to file a better petition. The Court allowed the prayer to dismiss the application, holding that it was not pressed, and ordered that any future petition be served on the opposite party's counsel.

Issues considered

  • Whether the application under Section 482 Cr.P.C. is maintainable when the petitioners are not accused in the original order.
