Allahabad High Court

RAJKUMAR PANDEY ND 4 OTHERSversusState of U.P. AND ANOTHER

Decided

Holding

The application under Section 482 is dismissed as it is devoid of merit.

Summary

The petitioners filed an application under Section 482 of the Criminal Procedure Code seeking relief in a criminal matter. The opposite party informed the court that the case had been referred to the Mediation & Conciliation Centre, where mediation was completed but no settlement was reached. The opposite party also argued that a prima facie case existed against the petitioners based on the complaint and statements recorded under Sections 200 and 202 of the Cr.P.C. The court examined the application and found it to be without merit. Consequently, the court dismissed the application under Section 482.

Issues considered

  • Whether the application under Section 482 Cr.P.C. is maintainable in view of the pending mediation proceedings and the existence of a prima facie case against the petitioners.
