Allahabad High Court

RAM PRATAP AND 2 OTHERSversusSTATE OF U.P. AND ANOTHER

Decided

Holding

A High Court may quash criminal proceedings under Section 482 Cr.P.C. where the parties have settled the dispute, as continuation would be futile and contrary to the ends of justice.

Summary

The applicants filed a petition under Section 482 of the Criminal Procedure Code seeking to quash the charge‑sheet, cognizance and summons in a criminal case (Criminal Case No. 19385 of 2024) involving offences under Sections 323, 504, 506 and 308 IPC. Both parties submitted that they had settled the dispute by a compromise dated 26‑11‑2024, which was verified by the trial court. The State, as a respondent, did not oppose the settlement. Relying on the Supreme Court’s decision in Gian Singh v. State of Punjab, the High Court held that continuation of criminal proceedings despite a settlement, even of non‑compoundable offences, would be futile and contrary to the ends of justice. Consequently, the High Court allowed the application and quashed the entire criminal proceedings. The order also directed the parties to file a certified copy with the trial court within six weeks.

Issues considered

  • Whether a High Court may quash criminal proceedings under Section 482 Cr.P.C. when the parties have reached a settlement, even though the offences are non‑compoundable.
