Holding
No interference is warranted under Section 482; the application is dismissed.
Summary
The applicants filed an application under Section 482 of the Cr.P.C. seeking interference with the trial court's order that referred the matter to the Mediation and Conciliation Centre. The High Court noted that the mediation report dated 30.05.2025 showed that mediation was completed but no settlement was reached. Upon reviewing the complaint and the statements recorded under Sections 200 and 202 of the Cr.P.C., the Court found that a prima facie case of offence existed against the applicants. Consequently, the Court held that there was no ground for interference under its inherent powers. The application was therefore dismissed.
Issues considered
- Whether the High Court should exercise its inherent powers under Section 482 to interfere with the order referring the case to mediation
- Whether the existence of a prima facie case under Sections 200 and 202 Cr.P.C. precludes interference
