Allahabad High Court

ANEES AND 5 OTHERSversusSTATE OF U.P.AND ANOTHER

Decided

Holding

The High Court held that, given the verified amicable settlement, it may quash the proceedings under its inherent powers under Section 482 of the CrPC.

Summary

The applicants and the State entered into a compromise concerning criminal case No. 6186 of 2016, which involved offences under IPC sections 420, 467, 468 and 471. The compromise was verified by the Additional Chief Judicial Magistrate on 21‑01‑2026, and both parties and the A.G.A. raised no objection to its effect. The applicants filed an application under Section 482 of the CrPC seeking quash of the pending proceedings. The High Court, after considering the verified settlement and the submissions of counsel, held that it was in the interest of justice to exercise its inherent powers and dismiss the case. Consequently, the charge‑sheet, cognizance order and all proceedings were quashed, and the application was allowed.

Issues considered

  • Whether the High Court can quash pending criminal proceedings under Section 482 of the CrPC on the basis of a compromise between the parties, including for offences that are ordinarily non‑compoundable.
