Allahabad High Court

LEEMU ALIAS ALIMUDDIN AND 7 OTHERSversusState of U.P. AND ANOTHER

Decided

Holding

The High Court held that, on account of a duly verified compromise, the criminal proceedings must be quashed under its inherent powers under Section 482 of the Cr.P.C.

Summary

The applicants filed an application under Section 482 of the Criminal Procedure Code seeking to quash the criminal proceedings (Case No.1547 of 2018) arising from Crime No.122 of 2013, which involved offences under Sections 147, 148, 149, 379, 489 of the IPC and Sections 3 and 5 of the SC/ST (Prevention of Atrocities) Act. Both parties had entered into a compromise, which was verified by the Additional Sessions Judge/Special Judge of the SC/ST Act in Shamli, and a report was sent to the High Court. Relying on a series of Supreme Court decisions that recognize the court’s inherent power to quash proceedings where a lawful compromise exists, the High Court held that the verified compromise justified dismissal of the case. Consequently, the court ordered that the proceedings be quashed and directed the lower court not to proceed further. The application was therefore allowed.

Issues considered

  • Whether a compromise between the parties, verified by a special judge, can be a ground for quashing criminal proceedings under Section 482 Cr.P.C.
  • Whether the High Court has jurisdiction to quash offences under the IPC and the SC/ST (Prevention of Atrocities) Act on the basis of a compromise.
