Allahabad High Court

UTTAM PAL AND ANOTHERversusSTATE OF U.P. AND ANOTHER

Decided

Holding

The High Court held that, given the verified settlement, the criminal proceedings were liable to be quashed under Section 482 of the CrPC.

Summary

The petitioners filed an application under Section 482 of the Criminal Procedure Code seeking to quash criminal proceedings (Criminal Appeal No. 1934/2022) arising from a case registered under Sections 498A, 323, 506 of the IPC and the Dowry Prohibition Act. The parties claimed that they had reached a settlement, which was verified by the lower court on 17‑10‑2023. Relying on several Supreme Court precedents, the petitioners argued that the matter should be dismissed in view of the compromise. The High Court examined the settlement deed, the verification order, and the cited case law, and held that the application was maintainable. Consequently, the Court accepted the petition, quashed the pending criminal proceedings, and treated any interim orders as terminated.

Issues considered

  • Whether the criminal proceedings under Sections 498A, 323, 506 IPC and the Dowry Prohibition Act can be quashed under Section 482 CrPC on the ground of a settlement between the parties.
