Allahabad High Court

ASIM AND 4 OTHERSversusSTATE OF U.P.

Decided

Holding

The High Court held that, since the parties entered into a voluntary, verified compromise, the criminal proceedings could be quashed under its inherent powers under Section 482 CrPC.

Summary

The applicants filed an application under Section 482 of the Criminal Procedure Code seeking to quash the summoning order dated 07.05.2019 and the entire criminal proceedings (Complaint Case No. 5597 of 2018) relating to offences under Sections 323, 324, 354, 354B and 452 of the IPC. Both parties claimed to have reached a written compromise on 22.02.2023, which was verified by the trial court in the presence of the parties. The court examined whether the compromise was voluntary and free of coercion and noted that the trial court’s verification satisfied procedural requirements. Relying on a series of Supreme Court decisions that permit quashing of criminal matters where the parties have settled their disputes, the High Court exercised its inherent powers under Section 482. The application was allowed and the summoning order and all pending proceedings were quashed.

Issues considered

  • Whether a criminal proceeding can be quashed under Section 482 CrPC on the basis of a voluntary compromise between the parties.
  • Whether the verification of the compromise by the trial court satisfies the requirement for quashing the proceedings.
