Allahabad High Court

RAJPAL SINGH AND 2 OTHERSversusSTATE OF U.P. AND ANOTHER

Decided

Holding

The High Court held that the proceedings could be quashed as the parties had reached a verified compromise.

Summary

The applicants filed an application under Section 482 of the Criminal Procedure Code seeking to quash a charge sheet dated 31‑12‑2014 and the related proceedings in a case under Section 308 IPC, on the ground that the dispute had been amicably settled by compromise. The trial court had verified the compromise on 05‑04‑2023, and the opposite party expressed no intention to pursue the matter or produce evidence. The State and the opposite party could not dispute the settlement. The Court referred to Supreme Court precedents that allow quashing of criminal proceedings where parties have settled their grievances. Applying this law, the High Court allowed the application, quashed the charge sheet and proceedings, and conditioned the order on a deposit of Rs.20,000 by each applicant and the opposite party to be utilized by the District Legal Services Authority.
