Allahabad High Court

SANTOSH KUMAR SAXENAversusSTATE OF U.P. AND ANR

Decided

Holding

The High Court held that, given the verified compromise and the parties' settlement, the criminal proceedings must be quashed.

Summary

The applicant filed an application under Section 482 of the CrPC seeking to quash Criminal Case No. 1137 of 2010 (State vs. Santosh Kumar Saxena), which involved offences under Sections 406, 420, 467, 468 and 471 IPC. The parties had reached a compromise, which was verified by the trial court as directed by a coordinate bench of the High Court. Both the State and the opposite party consented to the quashal. The Court referred to several Supreme Court judgments that permit compromise even for cognizable and non‑compoundable offences. Considering that the dispute was settled and no further purpose would be served by continuing the trial, the Court quashed the criminal proceedings. The application was allowed without any order as to costs.

Issues considered

  • Whether a compromise between parties can be the basis for quashing criminal proceedings under Section 482 CrPC for offences that are cognizable and non‑compoundable under the IPC.
