Allahabad High Court

SANJAY SINGHversusSTATE OF U.P. AND ANOTHER

Decided
Disposal
Allowed/Partly Allowed on merits

Holding

The High Court quashed the summons and the entire criminal proceedings under Section 482 CrPC, allowing the compromise application.

Summary

The applicant filed a petition under Section 482 of the CrPC seeking to quash the summons dated 13.01.2021 and stay the criminal proceedings (sections 354A, 323 and 406 IPC) in Complaint No. 3813 of 2020 (Sweta Singh v. Abhishek Singh). The parties had amicably settled the dispute and filed a compromise application, which was verified by the trial court. Relying on several Supreme Court decisions that permit the High Court to set aside criminal proceedings where a genuine compromise exists, the court examined whether the offences, though non‑compoundable, could be extinguished on settlement. The court held that the compromise was bona‑fide and, in the interest of justice, the proceedings should be quashed. Consequently, the summons and the entire criminal case were set aside. The application was allowed.

Issues considered

  • Whether a High Court may quash criminal proceedings under sections 354A, 323 and 406 IPC on the basis of a compromise between the parties.
  • Whether Section 482 CrPC empowers the court to set aside a summons and stay proceedings in non‑compoundable offences when a settlement is reached.
