SMT KUMUD SAWAIKAversusRELIANCE NIPPON LIFE INSURANCE COMPANY LIMITED AND 2 OTHERS

Decided

Holding

The High Court appointed retired District Judge Sunil Kumar Gupta as arbitrator, allowing the arbitration application.

Summary

Smt. Kumud Sawaika filed an application under Section 11(4) of the Arbitration and Conciliation Act, 1996 seeking the appointment of an arbitrator to resolve a dispute with Reliance Nippon Life Insurance Company Limited and two other respondents. The High Court examined whether the proposed arbitrator, retired District Judge Sunil Kumar Gupta, satisfied the eligibility criteria under Section 11(8) of the Act. After considering the consent of the proposed arbitrator, the Court found no impediment to his appointment. The Court ordered that Mr. Gupta be appointed as the arbitrator and that he be entitled to fees and expenses as per the Fourth Schedule of the Act. Consequently, the arbitration application was allowed, and the parties were directed to inform the arbitrator of the order. The decision underscores the Court’s role in facilitating arbitration by ensuring compliance with statutory appointment provisions.
