Allahabad High Court

M/S CHHONKAR ASSOCIATES MATHURAversusUNION OF INDIA AND ANOTHER

Decided

Holding

Justice Satish Chandra is appointed as arbitrator and the arbitration venue is corrected to Delhi NCR.

Summary

The applicant, M/s Chhonkar Associates, filed an arbitration application under Section 11(4) of the Arbitration and Conciliation Act, 1996, seeking appointment of an arbitrator. The court recorded the consent of former High Court Judge Justice Satish Chandra to act as arbitrator under Section 11(8). The court appointed him, directed that he be paid fees as per the Fourth Schedule of the Act, and allowed the arbitration application. An earlier order had directed that the arbitration be conducted at Prayagraj, but the court corrected the venue to Delhi NCR upon notice. The order thus finalised the arbitrator’s appointment and the venue of the proceedings.

Issues considered

  • Whether Justice Satish Chandra’s consent under Section 11(8) suffices for his appointment as arbitrator.
  • Whether the venue of the arbitration should be Prayagraj as initially ordered or Delhi NCR.
