Allahabad High Court

PRINCEversusSTATE OF U.P.

Decided

Holding

The Court held that the applicant is entitled to bail, subject to prescribed conditions, as the case rests on a solitary base case and no merit assessment was required.

Summary

The High Court considered a bail application filed by Prince, who was arrested in connection with Crime No. 321 of 2025 under sections 2 and 3 of the U.P. Gangster and Anti‑Social Activities (Prevention) Act. The applicant claimed he was falsely implicated based on a solitary base case and that he was already on bail in the same matter, while also having six other pending cases. The State opposed bail but could not refute the applicant's contentions. After reviewing the record and the applicant's affidavit, the Court, without expressing an opinion on the merits, concluded that the applicant was entitled to bail. The Court ordered his release on personal bond and two sureties, subject to conditions prohibiting tampering with evidence, criminal activity, intimidation of witnesses, and mandating regular court appearances. The order also directed electronic transmission of the release order to ensure prompt discharge.

Issues considered

  • Whether the applicant is entitled to bail under sections 2/3 of the U.P. Gangster and Anti‑Social Activities (Prevention) Act despite a solitary base case and prior criminal history
