Allahabad High Court

DHEERAJ SAHNI AND ANOTHERversusSTATE OF U.P.

Decided

Holding

The court dismissed Dheeraj Sahni's bail application as withdrawn and rejected Satendra Sahni's bail plea, holding that the seriousness of the injuries precludes bail.

Summary

The High Court heard bail applications filed by two accused, Dheeraj Sahni and Satendra Sahni, in a criminal case (Crime No. 299 of 2025) involving alleged assault and grievous injuries. Dheeraj Sahni’s counsel voluntarily withdrew his bail plea, leading the court to dismiss the application as withdrawn. Satendra Sahni pleaded innocence, arguing that the FIR only assigned a general role to the accused and that medical evidence showed only minor injuries to most victims. The State’s Additional Government Advocate countered that the victims, especially Angad Sahani, suffered serious injuries, including cerebral bleed and skull fracture, as reflected in CT scans. After evaluating the submissions and medical reports, the court concluded that the gravity of the injuries warranted denial of bail and rejected Satendra Sahni’s bail application.

Issues considered

  • Whether Dheeraj Sahni's bail application should be dismissed as withdrawn.
  • Whether Satendra Sahni is entitled to bail despite the alleged involvement in assault causing grievous injuries.
