Allahabad High Court

SATYAPAL SINGHversusSTATE OF U.P.

Decided

Holding

Bail is granted to the applicant under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023.

Summary

The High Court of Allahabad considered a bail application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 on behalf of Satyapal Singh, who was arrested in a cyber‑fraud case (Crime No. 25 of 2025) involving alleged misappropriation of Rs 2,20,000 and cash of Rs 1,40,000. The applicant claimed false implication and argued that the FIR was lodged against unknown persons, with his name surfacing only during investigation. The State opposed bail, citing the chargesheet and the seriousness of offences under Sections 318(4), 317(2), 338, 336(3), 340(2) of the B.N.S.S. and Section 66 of the IT Act. After reviewing the record, the judge, without expressing an opinion on the merits, found the case fit for bail and ordered release on a personal bond of Rs 50,000 with two sureties, imposing conditions to prevent witness tampering and ensure presence at trial. The order expressly limited its scope to the bail application and did not prejudice the trial court’s future findings.

Issues considered

  • Whether bail should be granted to the accused under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in a cyber‑fraud case involving multiple serious offences.
  • Whether the applicant’s claim of false implication and the risk of evidence tampering warrant denial of bail.

Court No. - 69
                    HON'BLE JITENDRA KUMAR SINHA, J.

1. Heard Sri G.S. Chauhan, learned counsel for the applicant, Sri B.P. Maurya, learned
AGA for the State-respondents and perused the record.

2. The present bail application under Section 483 of Bharatiya Nagarik Suraksha
Sanhita, 2023, has been filed on behalf of applicant with a prayer to release him on
bail in Case Crime No. 25 of 2025 under Sections 318(4), 317(2), 338, 336(3), 340(2)
BNS and 66 I.T. Act, registered at Police Station Cyber Crime, District Auraiya
during pendency of the trial.

3. It has been argued by the learned counsel for the applicant that applicant has been
falsely implicated in this case and the FIR has been lodged against unknown and name
of the applicant has surfaced during investigation. It is further submitted that
Rs.2,20,000/- is said to have been credited in the bank account of the applicant in the
alleged cyber fraud and cash above Rs.1,40,000/- is also said to have been recovered
from the applicant and co-accused. It is further submitted that chargesheet in the case
has been submitted and the applicant has been languishing in jail since 23.11.2025. It
is also submitted that the applicant undertakes that he will not misuse the liberty, if
granted. It has also been pointed out that in the wake of heavy pendency of cases in
the Court, there is no likelihood of any early conclusion of trial.

4. On the other hand, learned A.G.A. has opposed the prayer for grant of bail to the
applicant.

5. FIR has been lodged against holders of mobile nos. 7423682044 and 6398432275
and during investigation, name of the applicant has surfaced and Rs.2,20,000/- is said
to have been credited in the bank account of the applicant in the alleged cyber fraud.
Chargesheet in the case has been submitted and the applicant has been languishing in
jail since 23.11.2025.

6. Upon considering the totality of facts, nature and the evidence reflected from record
                                                                                                     BAIL No. 10532 of 2026
                                                                         2

and without expressing any opinion on merits of the case, I find it to be a fit case for
bail. Hence, the present bail application is ALLOWED.

                                    7. Let the applicant Satyapal Singh involved in the aforesaid case crime be released

disclosing such facts to the court or to any police officer or tamper with the evidence.

(ii) The applicant shall not pressurize/intimidate the prosecution witnesses.

                                    cancellation of bail.

                                    9. It is clarified that anything said in this order is limited to the purpose of
