Allahabad High Court

PANKAJ SINGHversusSTATE OF U.P.

Decided

Holding

The court held that bail cannot be enlarged for the applicant given the grave nature of the injuries sustained by the victim.

Summary

The applicant, Pankaj Singh, was arrested in connection with a 2006 assault case (Crime No. 20) involving multiple injuries to the victim, Ranvir Pratap Singh, and is seeking enlargement of bail during trial. The applicant claims he is innocent, falsely implicated due to village factional politics, and that no specific role or injury is attributable to him. The State contends that the victim suffered grievous injuries, including contusions, fractures, and a cerebral hemorrhage, indicating serious assault. The court examined the medical reports detailing the injuries and found them indicative of a severe assault. Considering the seriousness of the injuries and the allegations, the court declined to enlarge bail and rejected the application.

Issues considered

  • Whether the applicant is entitled to enlargement of bail during the pendency of trial despite the serious injuries alleged against the victim.
  • Whether the applicant's alleged lack of specific involvement and absence of prior criminal record warrant bail.
