Allahabad High Court

MOHD. NAZIRversusSTATE OF U.P. AND 3 OTHERS

Decided

Holding

The Court granted bail to the applicant, finding that he had made out a case for release.

Summary

The High Court considered a bail application filed by Mohd. Nazir, who was in custody since 9‑December‑2024 for offences under Sections 65(1), 351(2), 74 BNS of the IPC and Sections 5, 6, 9 and 10 of the POCSO Act. The applicant claimed innocence, asserting that the informant and victim, who were initially witnesses, turned hostile during trial, undermining the prosecution's case. The State opposed bail but could not refute the applicant's submissions. After reviewing the material and noting the lack of a likelihood of conviction, the Court found that the applicant had made out a case for bail. Consequently, the Court ordered his release on personal bond and two sureties, subject to standard conditions, without prejudice to the trial on merits.

Issues considered

  • Whether bail should be granted to the accused under the specified IPC and POCSO provisions given the turning hostile of key witnesses and the alleged lack of likelihood of conviction.
