Allahabad High Court
SHIVAM PATELversusSTATE OF U.P.
- Decided
Holding
The Court held that the applicant is entitled to bail.
Summary
The High Court considered a bail application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, on behalf of Shivam Patel, who was arrested in a cyber‑fraud case (Crime No. 72 of 2025) involving Sections 318(4), 338, 61(2) of the BNS and Section 66(d) of the IT Act. The applicant claimed innocence, pointed out that co‑accused had already been granted bail, and asserted that no money had been received in his bank account. The State opposed bail, citing the recovery of two mobile phones and WhatsApp chats from the applicant’s possession. After reviewing the record, the Court, without opining on the merits, found the case suitable for bail and ordered the applicant’s release on a personal bond of Rs. 50,000 with two sureties, subject to several conditions. The order expressly limited its effect to the bail application and did not prejudice the trial court’s future findings.
Issues considered
- Whether bail should be granted to the accused under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, in view of the alleged cyber‑fraud and the evidence recovered from his mobile phones.
