Allahabad High Court
SUNIL KUMAR YADAVversusSTATE OF U.P. AND ANOTHER
- Decided
- Bench
- KRISHAN PAHAL
Holding
The court granted bail to the applicant, subject to bond and surety conditions.
Summary
Sunil Kumar Yadav was arrested in connection with a case under Sections 69, 89 and 351(3) of the BNS, alleged to involve an honor‑killing scenario where the victim died after her parents intervened in a consensual relationship. The applicant contended that he was falsely implicated, had no prior criminal record, and had been in custody since 25‑03‑2026. The State opposed bail, citing the seriousness of the offences and the pending honor‑killing case against the victim’s mother and brother. The court examined the facts, the nature of the offences, and the applicant’s claim of innocence, and concluded that bail was appropriate. Accordingly, the court ordered his release on personal bond and two sureties, subject to conditions of non‑tampering with evidence, non‑intimidation of witnesses, and regular appearance before the trial court.
Issues considered
- Whether bail should be granted to the accused in a case involving alleged honor‑killing and sections 69, 89, 351(3) of the BNS.
- Whether the applicant’s claim of false implication and lack of criminal history outweigh the seriousness of the alleged offences.
