Allahabad High Court

MANOJversusSTATE OF U.P.

Decided

Holding

The court held that the applicant is entitled to bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023.

Summary

The High Court of Allahabad considered a bail application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, on behalf of Manoj, who was arrested in a case under Sections 2 and 3 of the Uttar Pradesh Gangster and Anti‑Social Activities (Prevention) Act. The applicant contended that he was falsely implicated, was already on bail in two other related cases, and had a criminal history involving four other matters, three of which were under notice under Section 41‑A of the Cr.P.C. The State opposed the bail, citing the seriousness of the offences and the applicant’s pending cases. After reviewing the record, the court, without expressing an opinion on the merits, found the circumstances suitable for bail and ordered release on a personal bond of Rs. 50,000 with two sureties, imposing standard conditions to prevent tampering or intimidation of witnesses. The order expressly limited its effect to the bail application and did not prejudice the trial court’s future findings.

Issues considered

  • Whether the applicant is entitled to bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in a case instituted under the Uttar Pradesh Gangster and Anti‑Social Activities (Prevention) Act
  • Whether the applicant’s criminal history and pending notices under Section 41‑A Cr.P.C. justify denial of bail

it to be a fit case for bail. Hence, the present bail application is allowed.
