Allahabad High Court

MUSTAHID ALIAS BHURAversusSTATE OF U.P.

Decided

Holding

The bail application is allowed, and the applicant is released on bail subject to conditions.

Summary

The High Court considered a bail application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, on behalf of Mustahid alias Bhura, who was arrested in a case under Sections 8 and 21 of the Narcotic Drugs and Psychotropic Substances (NDPS) Act for allegedly possessing 21 grams of 'smack', a quantity below the commercial threshold. The applicant claimed innocence, argued that the mandatory provisions of Section 50 of the NDPS Act were not complied with, and highlighted his three prior criminal cases while seeking release pending trial. The State opposed bail, but the Court, after reviewing the record and invoking Section 37 of the NDPS Act and the precedent set in Union of India v. Shiv Shanker Kesari (2007) 7 SCC 798, found the case suitable for bail. The Court granted bail subject to a personal bond of Rs. 50,000 with two sureties and imposed conditions to prevent tampering with evidence or intimidation of witnesses. The order expressly limited its scope to the bail application and did not comment on the merits of the underlying criminal case.

Issues considered

  • Whether the applicant is entitled to bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, in a case governed by the NDPS Act.
  • Whether the mandatory provisions of Section 50 of the NDPS Act have been complied with, justifying denial of bail.
  • Whether the quantity of narcotic seized (21 grams) being below commercial quantity impacts the bail consideration.
