Allahabad High Court

RAJAN SHARMAversusSTATE OF U.P.

Decided

Holding

The court held that the applicant is entitled to bail.

Summary

Rajan Sharma, a Consolidation Lekhpal, was arrested for demanding Rs.2,00,000 and allegedly accepting a settlement of Rs.20,000 for a demarcation report, and was caught with the money. He is charged under Section 7 of the Prevention of Corruption Act, 1988 (as amended 2018) and has been in custody since 10‑12‑2025 with no prior criminal record. The State opposed bail but did not allege any risk of flight, witness intimidation, or evidence tampering. The court examined the lack of material showing such risks and noted that bail is intended to secure attendance, not to punish. Finding no substantive grounds to deny bail, the court granted the application subject to standard conditions and sureties. The bail order was issued on 5 May 2026.

Issues considered

  • Whether the accused, charged under Section 7 of the Prevention of Corruption Act, is entitled to bail.
  • Whether there is a likelihood of the accused tampering with evidence, intimidating witnesses, or fleeing if released on bail.
