Allahabad High Court

SACHIN THAKUR @ DAMARUversusSTATE OF U.P.

Decided

Holding

The applicant is entitled to be released on bail.

Summary

The High Court considered a bail application filed by Sachin Thakur, who was arrested under Sections 2 and 3 of the U.P. Gangsters and Anti-Social Activities (Prevention) Act, 1986, in Crime No. 27 of 2026. The applicant claimed he was falsely implicated based on a solitary base case (Crime No. 618 of 2025) for which he was already on bail and asserted that he had no other criminal antecedents. The State opposed the bail but could not refute the applicant's contentions. The Court, after reviewing the record and noting the lack of prior convictions, held that the applicant was entitled to bail without expressing an opinion on the merits of the underlying case. Accordingly, the Court ordered his release on bail subject to personal bond, sureties, and standard conditions such as non‑tampering with evidence and regular appearance in court. The order also directed procedural steps for the release through the Bail Order Management System.
