Allahabad High Court

HARSH SRIVASTAVAversusSTATE OF U.P.

Decided

Holding

The court held that the applicant had made out a case for bail and granted bail subject to conditions.

Summary

Harsh Srivastava applied for bail in a criminal case (Crime No.96 of 2026) under IPC Sections 69 and 351(2) BNS, alleged to have entered a false promise of marriage with the victim and later refused to fulfill it. The prosecution claimed deception, while the applicant’s counsel argued that the relationship was consensual, the victim was an adult, and there was no incriminating video or evidence of intimidation. The State opposed bail, asserting the seriousness of the allegations. The court examined the material, noted the absence of clinching evidence of deception and the victim’s consent, and concluded that a prima facie case for bail existed. Consequently, bail was granted on personal bond and two sureties, with conditions to not tamper with evidence, intimidate witnesses, and appear before the trial court.

Issues considered

  • Whether bail should be granted in a case under IPC Sections 69 and 351(2) BNS based on the facts presented.
  • Whether the prosecution has established a prima facie case of deception and criminal intimidation.
  • Whether the applicant poses a risk of tampering with evidence or influencing witnesses.
