Allahabad High Court

HARSHIT VARSHNEY HINDUversusSTATE OF U.P.

Decided

Holding

The court held that the applicant is entitled to bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023.

Summary

The High Court of Allahabad considered a bail application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, on behalf of Harshit Varshney, who was in custody since March 13, 2026 for offences including sections 191(2), 191(3), 125, 109(1), 115(2), 352, 351(3) of the BNS, the Criminal Law Amendment Act and the Arms Act. The applicant claimed innocence, pointed out that nine co‑accused had already been released on bail, and argued that no specific role was assigned to him in the FIR. The State opposed bail, citing the seriousness of the charges and the applicant’s criminal history. After reviewing the record, the court, without expressing an opinion on the merits, found the case suitable for bail and ordered release on a personal bond of Rs. 50,000 with two sureties, subject to conditions to prevent tampering with evidence or intimidation of witnesses. The order expressly limited its effect to the bail application and did not prejudice the trial court’s independent assessment.

Issues considered

  • Whether the applicant is entitled to bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in view of the nature of the offences charged.
  • Whether the applicant poses a risk of flight, evidence tampering, or intimidation of witnesses.
  • Whether the applicant’s prior criminal history justifies denial of bail.

further submitted that the 09 co-accused have already been
granted bail by a co-ordinate Bench of this Court as well as by this

said to have indulged in fighting with each other as a result of
