Allahabad High Court

SAURABHversusSTATE OF U.P. AND 3 OTHERS

Decided

Holding

The bail application was dismissed as infructuous because the applicant had already been released.

Summary

The High Court of Allahabad considered a bail application (Criminal Misc. Bail Application No. 15592 of 2025) filed by Saurabh against the State of Uttar Pradesh and three others. No counsel appeared for the applicant, while the State's learned A.G.A. was present. The trial court's status report indicated that the applicant had already been released from custody on 12 December 2025 following the Court’s earlier order dated 9 December 2025, which declared him a juvenile under Section 528 of the BNSS. Since the applicant was no longer in detention, the bail application became moot. Consequently, the Court dismissed the bail application as infructuous.
