Allahabad High Court

MUKESHversusSTATE OF U.P.

Decided

Holding

The court granted bail to the applicant, finding the case fit for release on bail under Section 483 B.N.S.S.

Summary

The High Court of Allahabad considered a bail application filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, for Mukesh, who was arrested in a case under Sections 2(Kha)(1) and 3(1) of the Uttar Pradesh Gangster and Anti‑Social Activities (Prevention) Act. The applicant claimed innocence, highlighted that he was already on bail in three other matters, and argued that prolonged detention was unwarranted given court pendency. The State opposed the bail, citing the seriousness of the offences. After reviewing the facts and the evidence, the court, without expressing an opinion on the merits, found the case suitable for bail and ordered release on a personal bond of Rs. 50,000 with two sureties, imposing standard conditions to prevent tampering or intimidation of witnesses. The order clarified that it does not prejudice the trial court’s future determination of guilt.

Issues considered

  • Whether the applicant is entitled to bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 in a case under the U.P. Gangster and Anti‑Social Activities (Prevention) Act
  • Whether the applicant’s prior bail in other matters and the pendency of trial justify granting bail
