Allahabad High Court
SASARAM NONIYAversusSTATE OF U.P.
- Decided
Holding
The court allowed the bail application, granting bail to the applicant subject to prescribed conditions.
Summary
The applicant, Sasaram Noniya, filed a bail application under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, seeking release in a cyber‑fraud case (Case Crime No. 46 of 2025) that also involves offences under Sections 303(2), 317(2), 317(5), 318(4), 61(2) of the BNS Act and Section 66D of the Information Technology Act. He claimed innocence, asserted that the FIR was lodged after a 65‑day delay, highlighted his clean criminal record, and pointed to the fact that a co‑accused had already been granted bail. The State opposed the bail. After reviewing the record, the court, without expressing an opinion on the merits, found the case suitable for bail and ordered the applicant’s release on a personal bond of Rs. 50,000 with two sureties, subject to standard conditions to prevent tampering with evidence or intimidation of witnesses.
Issues considered
- Whether the applicant is entitled to bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, in view of the nature of the alleged offences and the surrounding circumstances.
- Whether the conditions imposed on bail are appropriate and sufficient to safeguard the trial process.

already been granted bail by this Court vide order dated 30.4.2026

5. On the other hand, learned A.G.A. has opposed the prayer for
grant of bail to the applicant.
