Allahabad High Court

JAYPALversusSTATE OF U.P. AND 3 OTHERS

Decided

Holding

The court granted bail to the applicant, finding that he had made out a case for bail.

Summary

Jaypal was arrested in connection with a case involving offences under the Indian Penal Code and the POCSO Act. The victim, who had initially testified, turned hostile during trial, undermining the prosecution's case. The applicant pleaded innocence, asserted no prior criminal record, and argued that he would not misuse bail. The State opposed bail but could not refute the applicant's submissions. Considering the hostile witness and lack of convincing evidence, the court found that the applicant had made out a case for bail and ordered his release on personal bond and sureties with standard conditions.

Issues considered

  • Whether bail should be granted to the accused given the charges under IPC and POCSO Act and the victim's hostile testimony.
